State and Federal Criminal Appeals
In most cases, a criminal Defendant has the right to appeal their conviction and/or sentence to the appellate courts of North Carolina or the United States Court of Appeals. A Defendant may give notice of appeal orally in open court or in writing within a specified period of time after a judge passes sentence. The appeals process can be very lengthy, lasting several months or even years. No evidence is presented nor do witnesses offer testimony as in the underlying trial. An appeal is a review of judicial procedure and error, and new evidence is not heard at this level. After consideration, an appellate court may issue an opinion, or decision, in as little as a month or as long as a year or more.
